Operator Terms of Service

1. About Empty Leg Scanner

Empty Leg Scanner (‘the Site’, ‘we’, ‘us’, ‘our’) is an online listing platform operated by Liam Bell trading as Empty Leg Scanner at emptylegscanner.com.

The Site enables private aviation operators (‘you’, ‘Operators’) to list discounted empty leg flights for passengers to browse and enquire about. Empty Leg Scanner acts solely as an advertising and introduction platform. We are not a party to any contract for carriage between you and a passenger, and we do not take bookings, process payments, or act as an agent for any party.

The Site is currently free to use for Operators. No fees, commissions, or referral payments are charged at this time.

2. How You Accept These Terms

During the operator registration process, you will be required to confirm that you have read and agree to these Operator Terms of Service and our Privacy Policy before your application can be submitted. You do this by ticking a confirmation checkbox — you cannot complete registration without doing so.

By ticking that checkbox, you enter into a binding agreement with us on the terms set out in this document. The date, time, and version of the Terms you accepted will be recorded and retained as part of your account record.

If you are registering on behalf of a company or other legal entity, you confirm that you have authority to bind that entity to these Terms, and that entity will be bound accordingly.

We may update these Terms from time to time. Material changes will be notified to you by email at least 14 days before they take effect. If you continue to use your account after the effective date, you will be taken to have accepted the revised Terms. Where the changes are material, we may ask you to confirm acceptance by ticking a new checkbox before you can continue to use your account.

3. Eligibility

To register as an Operator and list flights on the Site, you must:

• Be a legally constituted business entity
• Hold a valid Air Operator Certificate (AOC) or equivalent regulatory authorisation for the operations you advertise, issued by the appropriate civil aviation authority
• Maintain adequate public liability and aviation insurance appropriate to your operations and the flights you list
• Provide accurate and complete profile information during registration

By confirming acceptance of these Terms, you represent and warrant that you meet these requirements and will continue to do so for as long as your account is active. You must notify us immediately at hello@emptylegscanner.com if your regulatory status, AOC validity, or insurance coverage changes.

4. Account Registration and Approval

4.1 Approval Process

Submitting a registration application does not automatically entitle you to list flights. Operator accounts are subject to review and approval by Empty Leg Scanner. We reserve the right to approve, reject, or suspend any account at our sole discretion, including where we have reason to believe eligibility requirements are not met. We will notify you of the outcome of your application by email.

4.2 Verification Disclaimer

Empty Leg Scanner may, but is not obliged to, verify an Operator’s regulatory status, AOC validity, or insurance coverage. Approval of an account does not constitute verification or endorsement of an Operator’s regulatory compliance, safety record, or fitness to operate. Operators remain solely responsible for maintaining all required authorisations and ensuring their own compliance at all times.

4.3 Account Security

You are responsible for maintaining the confidentiality of your account login credentials and for all activity that occurs under your account. You must notify us immediately of any suspected unauthorised use at hello@emptylegscanner.com.

5. Listing Flights

5.1 Warranties on Listing

By submitting a flight listing to the Site, you represent and warrant that:

• The flight is a genuine empty leg flight that you or your client is authorised to operate and advertise
• All details in the listing — including route, date, departure time, aircraft type, passenger capacity, and price — are accurate, complete, and not misleading at the time of listing
• You hold all necessary regulatory permissions and insurance for the listed flight
• The listed price is the genuine price at which you are willing to accept enquiries
• You will respond to genuine passenger enquiries received via the Site within a reasonable time and in good faith — consistent failure to do so may result in review or suspension of your account

5.2 Prohibited Listings

You must not list:

• Flights that do not exist or are not genuinely available for the dates and routes advertised
• Flights operated by third parties unless you are formally authorised in writing to list and advertise on their behalf
• Flights in breach of any applicable law, regulation, or licensing requirement

5.3 Content Standards

All content you submit to the Site — including listings, photos, and profile information — must:

• Be accurate, truthful, and not misleading
• Comply with all applicable laws, including consumer protection and advertising standards regulations
• Not infringe the intellectual property rights of any third party
• Not contain offensive, discriminatory, or otherwise inappropriate material

We reserve the right to remove or edit any listing or content that does not comply with these standards, without notice and without liability to you. Repeated or serious breaches may result in permanent suspension of your account.

6. Operator Responsibilities

You are solely responsible for:

• The accuracy and legality of all content in your listings and profile
• All aspects of any flight you operate, including safety, crew, aircraft airworthiness, regulatory compliance, and passenger welfare
• Fulfilling any contract you enter into with a passenger following an introduction made via the Site
• Any claims, disputes, complaints, or liabilities arising from your flights or your conduct on the Site
• Ensuring all passengers you carry pursuant to an enquiry via the Site are carried in accordance with all applicable laws and regulations

Empty Leg Scanner is not responsible for and shall have no liability in respect of any act, omission, or default of an Operator in connection with any listed flight or subsequent carriage of a passenger.

7. Indemnity

Please read this section carefully — it is legally significant.

To the extent permitted by law, you shall indemnify, defend, and hold harmless Empty Leg Scanner and its officers, employees, and agents from and against any and all claims, actions, proceedings, losses, liabilities, damages, costs, and expenses (including reasonable legal costs) arising out of or in connection with:

• Any breach by you of these Terms
• Any inaccuracy, misrepresentation, or omission in any listing or content you submit to the Site
• Any act, omission, negligence, or default on your part in connection with any flight listed on or enquired about via the Site
• Any claim by a passenger or third party arising from a flight you operated following an introduction made via the Site
• Any infringement by you of any third party’s intellectual property rights or other legal rights

This indemnity shall survive the termination of your account and these Terms.

8. Fees and Commercial Terms

If commercial terms are introduced in the future, you will be given at least 30 days’ advance notice by email. Any such terms will be set out in a separate written agreement and will not form part of these Terms. You will have the opportunity to accept or reject any future commercial terms before they take effect.

9. Intellectual Property

All intellectual property rights in the Site, including its design, content, software, and database, belong to Empty Leg Scanner or its licensors. Nothing in these Terms grants you any rights in the Site’s intellectual property beyond the limited right to use the Site as described in these Terms.

By submitting content to the Site (including flight listings, photos, and profile information), you grant Empty Leg Scanner a non-exclusive, royalty-free, worldwide licence to use, display, and reproduce that content on the Site and in related promotional materials for the purposes of operating and marketing the Site. This licence terminates when the relevant content is removed from the Site, except where we have already published such content in external promotional materials, in which case we will use reasonable endeavours to remove or cease use of it within a reasonable period following your request.

You represent and warrant that you own or have the necessary rights to all content you submit, and that its use by us as described above will not infringe any third party’s rights.

10. Account Suspension and Termination

10.1 Termination by Us

We may suspend or terminate your account at any time if:

• We reasonably believe you have breached these Terms
• Your regulatory status changes such that you are no longer eligible to list on the Site
• We receive credible complaints about the accuracy of your listings or the conduct of your operations
• You have repeatedly failed to respond to genuine passenger enquiries
• We decide to discontinue the Site or any part of it

Where we consider it appropriate and safe to do so, we will provide notice before suspending or terminating your account. We reserve the right to act immediately without notice where necessary to protect passengers, the Site, or third parties.

In cases of serious or repeated breach, we reserve the right to permanently ban an Operator from registering a new account on the Site.

10.2 Termination by You

You may close your account at any time by contacting us at hello@emptylegscanner.com. Upon closure, your active listings will be removed from public view. Data retention will be handled in accordance with our Privacy Policy.

11. Disclaimers and Limitation of Liability

11.1 Site Availability

The Site is provided on an ‘as is’ and ‘as available’ basis. We do not guarantee uninterrupted or error-free operation and may suspend, withdraw, or restrict access at any time without notice.

11.2 Exclusion of Liability

To the fullest extent permitted by law, Empty Leg Scanner excludes all liability for:

• Any loss or damage arising from your use of, or inability to use, the Site
• Any loss of bookings, revenue, or business opportunities arising from the Site being unavailable or a listing being removed in accordance with these Terms
• Any act, omission, or conduct of any passenger who contacts you via the Site
• Any loss of profit, revenue, data, goodwill, or other indirect or consequential loss

Nothing in these Terms limits or excludes liability for death or personal injury caused by our negligence, fraud or fraudulent misrepresentation, or any other liability that cannot be excluded or limited by law.

12. Force Majeure

Empty Leg Scanner shall not be liable for any delay or failure to perform its obligations under these Terms to the extent caused by circumstances beyond its reasonable control, including failure of internet or telecommunications infrastructure, acts of God, fire, flood, pandemic, strikes, or the acts or omissions of third-party service providers including Cloudflare, Clerk, or Resend.

Where a force majeure event occurs, we will notify you as soon as reasonably practicable and will use reasonable endeavours to resume normal service as quickly as possible.

13. Governing Law and Dispute Resolution

These Terms are governed by and construed in accordance with the laws of England and Wales. Any dispute arising out of or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts of England and Wales.

If you have a complaint or concern, please contact us first at hello@emptylegscanner.com. We will acknowledge complaints within 5 business days and aim to respond fully within 28 days.

14. General

• Severability: If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall continue in full force and effect.
• Waiver: Failure to enforce any provision of these Terms shall not constitute a waiver of our right to enforce it subsequently.
• Entire agreement: These Terms (together with our Privacy Policy and any separate written commercial agreement) constitute the entire agreement between the parties relating to your use of the Site as an Operator.
• Assignment: Empty Leg Scanner may assign its rights and obligations under these Terms without your consent. You may not assign your rights or obligations without our prior written consent.
• Notices: Notices to you under these Terms will be sent to the email address associated with your account. Notices to us should be sent to hello@emptylegscanner.com.
